With the passage of the American Recovery and Reinvestment Act of 2009 (ARRA) funding to promote the use and adoption of electronic health records, and the HITECH privacy and security provisions to protect that information, healthcare organizations are scrambling to find better methodologies, policies and procedures, tools, technologies, and other means to ensure that their data is safe and protected.

As legislated by ARRA/HITECH, there will be additional requirements that make the original HIPAA regulations seem simple- breach notification rules, as well as tighter regulations on business associates and their partners, security is quickly becoming a major driver for investment from the health IT community and the government. In the coming months, we expect to see more controls and audits from internal risk management and auditors, the Office of Civil Rights, FTC, and States Governor’s Association. With so many entities involved in enforcing and promoting the protection of healthcare information, there will also be heavier penalties for non-compliance.

In this panel discussion, we will hear from government experts from the Centers for Medicare and Medicaid Services (CMS) and the Office of Civil Rights, on how they each intend to implement and then enforce these stringent privacy protections. We will also have an industry security expert discuss identity management and the use of such tools as multi-factor authentication, access roles and controls, policies and procedures, and other technologies that can be used to round out a robust security strategy. Together, the panel will discuss best practices for data to be exchanged securely, as well as protect PHI from fraud and abuse such as unintentional or inappropriate uses and disclosures and medical identity theft.
